I hope you will resist the temptation to butcher your Crape Myrtles.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Crape Myrtles are trees and should not be topped. In most cases, you can turn off the furnace by switching off the electrical power supply. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Close the main water valve or supply to your home. This valve is usually located in the basement or laundry room of your home. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;After the main valve has been securely turned off, open (or turn on) all inside faucets -- kitchen sink, bathroom sinks, tubs, showers and laundry room basin -- and all outside faucets. Also, be sure to remove garden hoses from the outside spigots. The purpose of opening all faucets is to drain all water from the pipelines within, and outside of, the home. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Drain the water heater. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Wrap "exposed" pipe with insulation. This happened to an individual who is renting in the community. His auto is a black in color Honda Accord. I do not believe any other reports have been filed in our neighborhood. This is the time of season for auto break ins to increase. The ordinance is in place to ensure peaceful enjoyment of private property. &lt;br /&gt;&lt;br /&gt;This only applies to people who live in neighborhoods, not those who live in rural areas. &lt;br /&gt;&lt;br /&gt;If you believe your neighbor isn't respecting your property or livability, you can report it to the Charleston County sheriff's office or bring a private action to the magistrate judge. &lt;br /&gt;&lt;br /&gt;"Now we've got a situation that really ensures that we're all good neighbors," said council member Colleen Condon. "That we have basic livability rights that we can ensure our neighbors rights don't infringe on ours."&lt;br /&gt;&lt;br /&gt;If you are found in violation of the livability ordinance, a deputy can write you a citation or a neighbor can take civil action against you in court. &lt;br /&gt;&lt;br /&gt;The City of Charleston has a similar ordinance. I was put in contact with Mr. Frank Carson who is the head of the Berkeley County Engineering Department. I received a letter from Mr. Carson that stated that Berkeley County would not accept ownership of the roads in Persimmon Hill for the following reasons:&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;1. No dedicated right of way (roadways are located in common areas)&lt;br /&gt;&lt;br /&gt;2. Parking areas within the “right of way”&lt;br /&gt;&lt;br /&gt;3. Roadway alignment/geometry not meeting standards&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Mr. Carson further stated “The development would have to conform to both the City’s development standards and the County’s standards for roadways. That would not be possible without obtaining numerous waivers and variances. County staff would not recommend approval of the required waivers/variances…In order to consider acceptance, we would require extensive sampling and testing by a geotechnical engineer, with a report recommending remediation methods. The remediation work would then have to be completed by the developer or HOA. Following completion of this construction we would require a two year warranty period during which time a 20% warranty security would be required.”&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;All of the above would, of course, require large expenditures of capital which is just not feasible. Apparently, the process is that a developer/builder can build according to county regulations (which, of course, is more costly) or build NOT according to regulations and the roads are then considered private. It is the developer’s choice. There are no city, state, or county laws that require builders to build roads according to their regulations.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;~ Kathy&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;FYI&lt;br /&gt;&lt;br /&gt;EXPENSES&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;During the months since the June meeting we have had the following expenses:&lt;br /&gt;&lt;br /&gt;Pipe Break: $1,400.00 &lt;br /&gt;&lt;br /&gt;Pump motor, upgrade Amperage; GFI receptacles: $3,737.00&lt;br /&gt;&lt;br /&gt;Fountain repairs $685.00&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;COMMUNITY IMPROVEMENTS&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The Garden of the Month program has been successful and it has been noticed that more homeowners are planting in their front gardens. That makes us all happy because it improves the appearance of our community.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;We would very much like to improve the entrance to Persimmon Hill, however, due to the lack of funds we have been unable to do that. We hope to make improvements this spring and everyone agrees that an attractive entryway is very important.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;As many have noticed there is a “no parking sign” at the end of Darcy Avenue. It states “No Parking Monday through Friday from 6:00 a.m. to 5:00 p.m” The reason for this was that it was reported the school buses found it very difficult to turn through the cul-de-sac and had threatened not to pick up children in that area because of the liability to the vehicles parked there. Thank you to all of our residents who have respected this change.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The “Doggy Station” that was installed at the main pond has been successful which can be revealed by the amount of bags used and deposited in the station. Our “clean-up lady” has been emptying the station. Thanks goes out to everyone who is making use of it and keeping our pond area clear of dog waste.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The Persimmon Hill pool will be closing on October 15th for the season. Several residents have asked why the glass top tables around the pool were being replaced. DHEC regulations prohibit glass tables at a public pool and we have a new pool inspector who is keeping to the letter of the law. We have received one citation for the glass top tables and thank goodness fines are not issued until a 3rd citation is issued. Therefore, we will be forced to replace all glass tables by the time the pool opens next spring.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;ANNUAL MEETING&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The Annual Meeting is scheduled for Thursday, December 8, 2011. As you know this is the meeting wherein the four open seats for the Board of Directors are elected. Anyone who is interested in running for the board needs to send your information and biography to Lynnette at CMG by the beginning of November. We all need to participate in our community, whether it is privately helping out, when possible, or joining a committee. Everyone’s assistance is needed and appreciated. Attendance at the Annual Meeting is VERY important because we need to have a minimum total of 10% homeowners in person, either present, or the homeowner’s proxy vote, in order to hold the elections. It costs us approximately $500 to send out a mailing to all homeowners which is required in our By-laws. If we DO NOT have the required 10% homeowner votes, we cannot hold elections and have to reschedule the meeting, thus sending out a second mailing (at another $500 cost) in order to hold the elections in January at which point we can, according to the By-laws, drop the required number of votes. Please keep this in mind when considering attending the Annual Meeting. ALL homeowners are encouraged to attend.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;REMINDERS:&lt;br /&gt;&lt;br /&gt;• Report any street light outage to Lynnette at CMG. Send her the number that is on the pole so she can report it properly.&lt;br /&gt;&lt;br /&gt;• All trash cans should be removed from the street by Saturday.&lt;br /&gt;&lt;br /&gt;• No parking on the grass – ANYWHERE. It damages the grass and sprinkler heads.&lt;br /&gt;&lt;br /&gt;• This fall, check the batteries in your smoke detectors and check your heat before the weather becomes really cold to ensure a good price from the repair company if repairs are needed. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Just a quick reminder for everyone on how your Association violations process works:&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;1st violation letter – warning 2nd violation letter – warning 3rd violation letter - $25 fine &lt;br /&gt;&lt;br /&gt;4th violation letter - $50 fine 5th violation letter - $100 fine 6th violation letter - $200 fine&lt;br /&gt;&lt;br /&gt;7th violation letter - $400&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Each letter that goes out will double in fines until the violation is corrected. The minutes were approved.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The financial report was given by Lynnette, announcing:&lt;br /&gt;&lt;br /&gt;As of August 31, 2011 - Operating account balance of $ 12,121.63&lt;br /&gt;&lt;br /&gt;Reserve balance of $ 355,284.33; &lt;br /&gt;&lt;br /&gt;Income $ 67,376.24&lt;br /&gt;&lt;br /&gt;Expenses $66,970.86 (which includes a reserve contribution of $7,264.00)&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Kathy read the President’s report given: &lt;br /&gt;&lt;br /&gt;* Follow up give regarding various meetings with city and county representatives regarding the status of the roads in Persimmon Hill. The county will not accept ownership of the roads due to multiple reasons.&lt;br /&gt;&lt;br /&gt;* Listed maintenance expenses since June&lt;br /&gt;&lt;br /&gt;* Update on the Garden of the Month program, and front entrance improvement&lt;br /&gt;&lt;br /&gt;* New “no-parking” sign at the end of Darcy Ave.&lt;br /&gt;&lt;br /&gt;* Follow up on the success of the Doggy Station at the end of Davenport.&lt;br /&gt;&lt;br /&gt;* Information regarding DHEC’s regulations prohibiting glass tables around the pool&lt;br /&gt;&lt;br /&gt;* The Annual meeting with board of directors’ election will be held the first part of December and the exact date will be announced. This hybrid tree is native to England. It prefers fertile and moist but well drained soils. Here in our subtropical climate, they can struggle with several fungal blights which often lead to tree mortality. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The trees located along Darcy have a Branch Dieback blight which is characterized by dying branches, open wound which ooze sap, and ultimately death. Planting these trees close together provides the perfect situation for the disease to spread. State law prohibits killing, harassing or possession of alligators.&lt;br /&gt;&lt;br /&gt;• Never feed or entice alligators-it is dangerous and illegal. When fed, alligators overcome their natural wariness and learn to associate people with food.&lt;br /&gt;&lt;br /&gt;• Inform others that feeding alligators is illegal and creates problems for others who want to use the water for recreational purposes.&lt;br /&gt;&lt;br /&gt;• Be aware of the possibility of alligator attacks when in or near fresh or brackish water bodies. Attacks could occur when people do not pay close enough attention to their surroundings.&lt;br /&gt;&lt;br /&gt;• Alligators are most active between dusk and dawn.&lt;br /&gt;&lt;br /&gt;• Dispose of fish scraps in garbage cans at boat ramps or fish camps. Do not throw them into the water. Although you are not intentionally feeding alligators when you do this, the end result can be the same as feeding.&lt;br /&gt;&lt;br /&gt;• Do not allow pets to swim, exercise or drink in waters that may contain alligators or in designated swimming areas with humans. It is illegal and very dangerous to do so. Your budget requires full funding in order to meet the expenses of the Association, which include insurance, grounds and building maintenance, pool maintenance, utilities, taxes, reserves etc. The only significant source of funds is member Assessments. If payment is not made, collections progresses in accordance with the Association’s Governing Documents through a series of letters and fees, Recording of a formal Lien with the County, progress through County court to secure a personal judgment for the balance owing, possible seizure and sale of property through the County Sheriff… &lt;br /&gt;&lt;br /&gt;Should these considerable efforts not succeed, the Association may only be left with costly legal action toward foreclosure of the home. &lt;br /&gt;&lt;br /&gt;While these steps may sound drastic and unpleasant, and they are, collection of 100% of Assessments is necessary to balance the budget. There are no “bailouts” and the Association has limited options. Failure to collect the amounts necessary to balance the budget require one of these options: Special Assessments to the well-paying owners to cover those who don’t pay, further cutting of services or insurance (higher risk to owners), borrowing from necessary reserves (delays the inevitable) or increasing Assessments to everyone… None of these are good options, particularly since the budget is already very VERY lean…&lt;br /&gt;&lt;br /&gt;Just like every household is doing its share of belt-tightening, every Homeowners Association in this economy is facing this challenge. Your Board and management are working diligently to keep YOUR fees low and we are focused on fairness. It is fair that everyone pay their share so that you don’t have to make up for those who choose not to pay. Nationally, the average delinquency is over 13% but due to focused efforts, your Association is in far better shape. This figure is improving as we progress. Here are few tips you can do to reduce your chances to save your life and the ones you love in the home. If you follow these steps, you can make a home a safer home to live in. &lt;br /&gt;&lt;br /&gt;• Change you smoke detectors every year.  It takes a 9 volt battery. The smoke detectors are both hard wired and battery backup power.&lt;br /&gt;• Make sure you have a small fire extinguisher in the kitchen area. Kitchen fires are climbing in a enormous rate every year. Please do not use water on a grease fire, this will cause the grease to flame up and cause serious damage to your stove, kitchen area and can cause serious burn injuries to you. &lt;br /&gt;• Make sure you clean out your dryer vent in your dryer after each use. This will reduce the chances of buildup in the dryer vent and hose to the outside vent. This will also will reduce the chances of fire in your dryer.&lt;br /&gt;• Please check your outside dryer vent for clogged lint every month. The lint will cause your dryer to heat up and cause your dryer to not dry your clothes and will cause a serious fire. Some townhomes have either an outside vent on the back patio or on the roof. The roof vents needs to be checked by a professional every 6 months. It’s amazing how many you hear out there,” said Jeff Hunt, of Cypress Creek in Hampton County.&lt;br /&gt;The slinking marauder of the West has slipped deep into South Carolina. The first one to show up in generations was spotted in Oconee County in 1978. Two years later, one was spotted in Berkeley County. In 1986, the second one to be found in the Low country turned up in Williamsburg County.&lt;br /&gt;Now, they are everywhere. They have established themselves as a nuisance rivaling the beaver. They have become one of the alpha predators in the state, ravaging young deer, wild turkey, rabbits and nearly anything else they can take a bite out of. They are a scourge for hunting plantations, fruit growers and pet owners alike.&lt;br /&gt;Wildlife officers worry they are about to become a bigger menace. They are moving into the suburbs, where they are problematic to hunt and too dangerous to trap, with domestic pets and children around.&lt;br /&gt;"When you've got to make your living going out and catching stuff, everything is potentially a meal," said Jay Butfiloski, S.C. Department of Natural Resources furbearer project supervisor.&lt;br /&gt;Coyotes occasionally do attack people, particularly rabid coyotes. The lone attack reported in the state so far was in 2009, on a 9-year-old girl in the Upstate waiting for a school bus. That coyote was rabid; the girl recovered from bites.&lt;br /&gt;The three-month trapping season for coyotes ends Monday. The S.C. Department of Natural Resources expects 25,000 or more of the critters will be taken. Most will be trapped in the Upstate, but 600 or 700 will be trapped in the three counties around Charleston, and about that many in Colleton County alone.&lt;br /&gt;Hunters calling for turkey look up to see coyotes peering at them, and then quickly vanishing. People hear them out their bedroom windows and have spotted them on the street around Summerville. Trapping in Mount Pleasant that began after pet dogs were attacked at Patriots Point last spring has taken 14 coyotes. There are more.&lt;br /&gt;"An officer saw one last week," said Capt. Stan Gragg of Mount Pleasant Police.&lt;br /&gt;"There are a lot of coyotes out there," said Ricky Williams, South Carolina Trappers Association president about the critter, which resembles a German shepherd. Help prevent injuries at Christmas and during the holidays by following these tips:&lt;br /&gt;&lt;br /&gt;1. Christmas tree safety begins with the selection and purchase of a fresh tree.  When buying a live pre-cut tree, make sure the tree is still alive and healthy.  A fresh tree is green, needles are hard to pull from the branches, and when bent between your fingers, needles do not break.  Pull on the needles. The trunk should be sticky and the limbs should be very flexible.  Lift the tree and bounce the cut end on the ground, if a bunch of needles come tumbling off, it isn’t a safe tree to take home.&lt;br /&gt;2. When you get the tree home, cut off the bottom two inches of trunk to expose the fresh wood.  This will create a fresh, raw cut for the tree to soak in water, allow for better water absorption and helps keep your tree from becoming a fire hazard.&lt;br /&gt;3. Keep your tree well hydrated.  Keep the water in the stand well above the fresh-cut bottom of the trunk. &lt;br /&gt;4. Christmas trees dry out with heat, so place your tree away from heat sources such as fireplaces or heater vents. &lt;br /&gt;5. When purchasing an artificial tree, look for the label “Fire Resistant”.&lt;br /&gt;6. Unplug the lights and decorations when you are not home.  &lt;br /&gt;7. Check each set of tree lights for frayed wires, broken bulbs and loose connections. &lt;br /&gt;8. Never run electrical cords under the carpets or rugs, over nails or in traffic areas.&lt;br /&gt;9. Before using lights outdoors, check labels to be sure they have been certified for outdoor use.  To hold lights in place, string them through hooks or insulated staples, not nails or tacks. Never pull or tug lights to remove them.  Plug all outdoor electric decorations into circuits with ground fault circuit interrupters to avoid potential shocks. &lt;br /&gt;10. In homes with small children, take special care to avoid decorations that are sharp or breakable, keep trimmings with small removable parts out of the reach of children to avoid the child swallowing or inhaling small pieces, and avoid trimmings that resemble candy or food that may tempt a young child to eat them. &lt;br /&gt;11. Remember that mistletoe, holly berries and Christmas cactus are poisonous if swallowed.&lt;br /&gt;12. Use care with “fire salts”, which produce colored flames when thrown on wood fires.  They contain heavy metals that can cause intense gastrointestinal irritation and vomiting if eaten. &lt;br /&gt;13. Do not burn wrapping papers in the fireplace. We also wish to stress the importance of citizens doing their part to protect themselves by not presenting opportunity-criminals with the chance to ruin your holiday.  &lt;br /&gt; Additional officers will be on high-visibility patrol around shopping areas, banks, and the like. They will also be available to provide bank escorts for businesses that request them.&lt;br /&gt; A particular problem this time of year is theft from automobiles and residential burglaries. These are the most preventable crimes. If citizens remove the opportunity, the crime is less likely to occur, and some types cannot occur at all.&lt;br /&gt; &lt;br /&gt;While Shopping or Going Out: &lt;br /&gt;• Secure valuables out of sight in your trunk. BUT, Be aware that many cars now have fold-down seats or a remote trunk release inside the car. These conveniences make your trunk vulnerable to thieves willing to break a window. &lt;br /&gt;• If at a mall or a shopping center, periodically go to the car and lock away purchases so they will not “disappear” when you put them down trying-on clothes or at the food court.&lt;br /&gt;• Safeguard your purse, wallet, bank cards, and personal information. Identity thieves thrive in this environment.&lt;br /&gt;• Keep close tabs on your children while shopping. With so many people it is easy for them to become lost. Make sure they know their full name, your full name, address, phone, and your cell or pager number to reach you if you get separated.&lt;br /&gt;• Be aware of your surroundings going to your car, going into and out of your house, and while at the ATM. &lt;br /&gt; &lt;br /&gt;At Home:&lt;br /&gt;• Make sure to keep doors and windows locked. &lt;br /&gt;• Turn on outside lights at night.&lt;br /&gt;• Report persons or vehicles roaming your neighborhood, day or night so police may check them. They may be simply looking at Christmas lights, or they may be “casing” houses to burglarize.&lt;br /&gt;• Place your tree where the gifts will be less visible from outside. Thieves like window-shopping through your windows. &lt;br /&gt;• After Christmas, don’t put the empty boxes out on the curb. This makes it easy for burglars to decide which houses to burglarize (ie: new computers, TVs, electronics, video games…). Break down boxes and put them in the trash, making sure to save all paperwork. Also remember many electronic devices require original boxes for warranty repair.&lt;br /&gt;• Immediately make an inventory listing the model and serial numbers of new items (and old ones if you haven’t already) and engrave personal markings on them&lt;br /&gt; &lt;br /&gt;If Leaving Home (On a trip or just for a little while):&lt;br /&gt;• Make it look like you are still there.&lt;br /&gt;• Timers on exterior lights, interior lights, and TVs will help make it look like you are home. Don’t leave an answering machine message saying you are gone, in fact turning it off would be better.&lt;br /&gt;• Double check all doors and windows, including second floor and basement. The doors should have dead-bolts; key locks for windows are also available.&lt;br /&gt;• Have the neighbor pick up mail, papers, and ads, put out your trash can, and park in your driveway. Give them emergency and cell numbers to reach you.&lt;br /&gt;• Call the police department to request a periodic residence check (“Keep-A-Check”) while you are away. (CPD Dispatch 577-7434)&lt;br /&gt;• When you return, look around outside first. If you see any evidence of a break-in, do not go inside. Go to a neighbor’s house and call police. The burglars could still be inside.&lt;br /&gt; &lt;br /&gt;While traveling: THINK SAFETY &lt;br /&gt;• Before you leave, inspect the car for safety (lights, belts and hoses, fluids, wipers, tires-both wear and air – DON’T FORGET TRAILER LIGHTS).&lt;br /&gt;• Pack expensive items in the trunk, or under coverings to keep them out of sight.&lt;br /&gt;• Pack safely. Items stacked in the back of a van, wagon, or SUV will become 60mph missiles in a crash! They also block the driver’s view. Items secured to the roof greatly alter the vehicle’s handling in wind and emergency maneuvers.&lt;br /&gt;• When you stop, take the keys and lock the doors. This applies all of the time, at home and away. An unlocked, running car invites a thief.&lt;br /&gt;• Use a CLUB or other device when parking for the night or at shopping centers Keep doors locked while driving. It adds strength in a collision.&lt;br /&gt;• Use seat-belts and child restraints properly.&lt;br /&gt;• Be careful with bank, gas, and credit cards.&lt;br /&gt;• Take regular rest breaks.&lt;br /&gt;• Never send your children into restrooms alone.&lt;br /&gt;• Store money in separate places to minimize loss or theft.&lt;br /&gt;• Stay on roads you know and take maps, cell phones, and chargers, as well as safety items like blankets, flashlights, jumper cables, a jack, and a good spare tire.&lt;br /&gt;• Drive carefully- better than those around you. You need to get there alive!&lt;br /&gt; &lt;br /&gt;Have a wonderful holiday season. Remember, most crimes and accidents are preventable. They will get most of the backyards done with the exception of areas on Brockman and Davenport that are very wet. The Associations landscape company is not responsible for entering your fenced in area and cutting, weed eating or pruning. &lt;br /&gt;&lt;br /&gt;On that note, below is some information regarding the landscape and irrigation schedule. Pruning will also begin September 7th 2010. &lt;br /&gt;&lt;br /&gt;Ecoscape was onsite Wednesday, 8am-6pm and Thursday, 8am-7pm. They began at the front entrance and replaced 402 - 6” spray heads, replaced 460 nozzles on existing spray heads, and replaced 31 rotors on the property. They also replaced several lateral line breaks and one main line break&lt;br /&gt;&lt;br /&gt;They repaired and replaced about 75% of Persimmon Hill. Ecoscape is still working with their vendor on the filtration system which will be presented at the next Board meeting (September 9th 2010 at 7pm). Ecoscape is still having an issue with two wires, one at the pool and the other by the two wire clock at the pond. They hope to have this resolved by the end of the week.&lt;br /&gt;&lt;br /&gt;We ask that you please do not attempt to fix any irrigation on your own. It is very simple to get rid of but almost always seems to pop up over night. It is not harmful to fish or other mammals. The water creates this bacteria when the water temperature is around 90 degrees. Aeration is the key to limiting the possibility of this not happening.&lt;br /&gt;&lt;br /&gt;On another note: The pond at the end of Davenport seems to have a crack in the weir structure. It has been temporary clogged with black trash bags, and wooden structure to maintain a sustainable water level to irrigate from during these hot months. As we get into the fall and the irrigation schedule changes, we will lower the ponds water level and fill in the crack(s) that exist with a quickcrete material to prevent the water level from falling. (Never flush water from outside the home, to the inside of the unit, a mess will occur!)&lt;br /&gt;&lt;br /&gt;If you don't have access to an open end of the drain from inside, you may need to disconnect or cut the drain line to perform the cleaning.  This should be done at least once every year and more often in areas where you use air conditioning more than 6 months of the year! Before signing the contract, the board sought bids from several potential companies, carefully considered the competence and expertise of each company, checked references, and compared fees.&lt;br /&gt; These fees may seem like an added—or even unnecessary—expense; but, in the long run, the additional cost will be less than the losses we would face without professional help. Consider the advantages:&lt;br /&gt; Professional Expertise: It takes more than a green thumb to maintain attractive and functional landscaping. Our contractor employs professional staff and trained labor crews. This expertise translates into a cost-effective and successful landscape maintenance program for our community.&lt;br /&gt; Bulk Purchase Savings: Our landscape contractor purchases plants and supplies in bulk quantities at reduced prices and passes the savings along to us. &lt;br /&gt; No Equipment to Buy or Maintain: The association doesn’t have to purchase, store, insure, maintain, or buy fuel for equipment. &lt;br /&gt; Improved Plant Survival: Trees, turf, shrubs, and other plantings are costly. Here’s half a dozen of the most common, and why it’s smart not to use them.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Excuse #1:  “I didn’t get what I paid for.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;“My building hasn’t been painted in five years! I’m not paying another cent until some basic maintenance gets done.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;“The power was out for three days during the storm. I’m withholding a pro-rated amount from my assessment check.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;You have a right to require the association to perform its duties, and various legal channels exist to accomplish this. Withholding assessments is not one of them. Your obligation to pay assessments has nothing to do with the association’s obligations to provide maintenance and service. If you withhold your check or pay a reduced amount, you’ll become delinquent, and that leads to late fees, and actually makes your situation worse. &lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Excuse #2: “You didn’t bill me.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;“I didn’t get an invoice.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;“You didn’t tell me I was behind in my payments.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Many association governing documents neither require the association to send invoices nor provide advance notice of payments due or past due. However, associations are required to send the approved budget to each owner annually and we do just that. When the association approves and sends the budget each year to our members, it contains notice of the amount you must pay annually. If you’re ever unsure about the amount or the due dates, just call the management office.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Excuse #3: “You can’t do that!”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;“These people have no right to make me pay for neighborhood upkeep.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;“If they think I’m paying those outrageous late fees and interest, they’re crazy.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Actually, the association not only has the authority, it has a duty to all owners to collect assessments. This authority is established in the governing documents and the state’s common interest ownership statutes. When you moved into a community association, you agreed to abide by those documents—and that includes paying assessments.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Excuse #4: “I never use the recreational facilities.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;“I don’t play golf, and it’s an expensive game. I shouldn’t have to pay to maintain the course.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;“I’ve never been in the fitness center, and I don’t plan to ever use it. Why can’t you pro-rate my assessments accordingly?”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Admittedly, recreational facilities are expensive to operate and—for some associations—represent a good chunk of the budget. Nevertheless, most declarations specify that even if you don’t use the association’s amenities you’re still obligated to pay for their upkeep.&lt;br /&gt;&lt;br /&gt;            Many of our residents moved into this community specifically for the recreational amenities; they’re willing to pay for them because they take full advantage of the opportunities they provide. Even if you’re not using some of the amenities, they make the community more desirable and the homes in the community more valuable. If you’re not using the facilities, perhaps you should consider whether this community is the best fit for you and your needs.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Excuse #5: “I paid in full.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Sometimes the Association receives a check that says “paid in full” in the memo section—but it isn’t. Or the check will arrive with a letter or note, stating the check is “payment in full,” or it covers all charges through a certain date. Nice try. If you still have an outstanding balance, you will have to pay what is still owed to the Assoicaition or you will just accrue more late fees.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Excuse #6: “The fees are too high.”&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Assessments reflect the actual cost of maintaining all common elements in the community. If you owned your home outside the association, you would have to pay individually for all the same expenses your assessments cover—trash removal, water, landscaping, and so on. In fact, you’re actually spending less on assessments because the association has bulk buying power, and you’re getting more because the common areas provide amenities that you likely could not afford on your own.&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Legitimate Reasons, not Excuses&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;When association members lose their jobs or become injured or ill, the association board understands that arrangements need to be worked out for paying assessments. If you have a legitimate reason for falling behind and you need to work out a payment plan, please call the manager. Next time you’re tempted to leave your dog’s droppings on the lawn, please remember these facts:&lt;br /&gt;&lt;br /&gt;1. The Environmental Protection Agency is becoming aggressive about enforcing the Clean Water Act. Our association could be fined if dog waste goes uncollected.&lt;br /&gt;&lt;br /&gt;2. Uncollected dog waste may lead to a special assessment. If fined by the EPA, the association could face a potential special assessment that would be levied against all members—not just dog owners.&lt;br /&gt;&lt;br /&gt;3. The appearance and quality of the common areas are known to affect home sales—not just whether and for how much they sell, but how quickly.&lt;br /&gt;&lt;br /&gt;4. The more residents complain about dog waste, the more time the manager must spend on enforcement rather than serving the association.&lt;br /&gt;&lt;br /&gt;5. She is trying to make sure that there is as much awareness as possible. It is so easy, all you have to do is leave a bag of food at, in or by your mailbox and the letter carrier picks it up and brings it back to the local post office. Secondly, you automatically become a member of the community association and all owners must abide by the covenants, conditions and restrictions.  Third, all owners will pay an assessment.  An assessment is a regular fee that is used for the upkeep of common area along with other services and &lt;span id="SPELLING_ERROR_1" class="blsp-spelling-corrected"&gt;amenities&lt;/span&gt;.  &lt;/li&gt;&lt;li&gt;Owners will find many advantages to living in this type of community.  At Persimmon Hill, each home receives weekly landscape maintenance and use of the on site pool.  These services may often be too expensive in a traditional situation, but are yours through shared ownership.  Mostly, you won't have the responsibility of the direct maintenance for these amenities. Everyone seemed to enjoy the event.&lt;/li&gt;&lt;br /&gt;&lt;li&gt;The pool is scheduled to open on April 1st. &lt;/li&gt;&lt;br /&gt;&lt;li&gt;Pressure washing for the buildings is scheduled to begin on May 1st. &lt;/li&gt;&lt;br /&gt;&lt;li&gt;Pine straw will be installed once the pressure washing is complete.&lt;/li&gt;&lt;br /&gt;&lt;li&gt;The Board has approved to remove several dead trees within the community.&lt;/li&gt;&lt;br /&gt;&lt;li&gt;The new installation of irrigation is complete for Phase I and II.
